What the Insurance Adjuster Doesn't Want You to Know

If you or a loved one has been injured in an accident, you will probably get a call from an insurance adjuster. Here are some secrets the insurance adjuster probably won't share with you.

  1. The careless driver's insurance company may offer to pay your medical bills and lost wages. However, under Utah law, we may be able to help you recover money for your pain and suffering, and changes in your lifestyle.

  2. Virtually every Utah car insurance policy includes "no fault" or PIP. This coverage is for medical expenses, lost wages, household expenses or death benefit. Ordinarily, you don't need an attorney to get PIP benefits and they should be paid no matter who was at fault in causing the accident. However, the careless driver's insurance company must generally pay your insurance company back for the insurance benefits paid to you. If you're not careful, you may accept a settlement that all the money goes in your pocket - only to learn later that part of it actually goes to your own insurance company to repay PIP.

  3. The careless driver's insurance company may be required to pay all medical bills and lost wages-past and future. Before we settle cases, we contact doctors to get estimates of future medical expenses and possible future changes to your lifestyle.

  4. There are many different types of insurance: underinsured coverage, uninsured coverage, and liability insurance. You may be entitled to benefits from more than one policy. But be careful. If you sign a release from an insurance adjuster, you might lose your rights to get benefits from other types of insurance.

  5. By Utah law, your settlement or recovery gets reduced by the percentage of your fault. For instance, if you were 10% at fault, your settlement would be reduced by 10%.  However, beware, the insurance adjuster might say he has done an investigation that shows that you are 30% at fault.   8. The insurance adjuster may recommend that you not hire an attorney. However, an attorney can point out things that you are entitled to which the insurance company is not obligated to tell you.
